GENERAL RENTAL CONDITIONS
INCO NORWAY AS/ VACATION HOME FEMTINI
1. APPLICABILITY
a. These conditions apply to all reservations and agreements regarding the vacation home to which Inco Norway AS has declared these conditions applicable, insofar as these conditions have not been expressly deviated from in writing.
b. An agreement between Inco Norway AS and the Tenant comes into effect when the Landlord has sent a reservation or order confirmation.
c. The terms and conditions apply to all guests of the vacation home.
d. The most recently sent version of these General Rental Conditions shall always apply.
e. If one or more of the provisions in these General Terms of Rental are at any time wholly or partially void or voidable, the remaining provisions of these General Terms of Rental will remain in full force.
f. Inco Norway AS has the right to change these Rental Terms unilaterally if it deems this necessary. The latest version will always be made available to the Renter for approval.
g. Inco Norway AS cannot guarantee that the work it performs will always achieve the result desired by Tenant. The accepted assignment leads to an obligation of effort and not to an obligation of result.
h. Inco Norway AS is entitled to engage Third Parties for the execution of the Agreement.
i. The Agreement concerns the rental of the vacation home for recreational use which by its nature is of short duration.
2. RESERVATION
a. A reservation of a vacation rental will only be considered by Inco Norway AS if the Renter, is 21 (twenty-one) years of age or older.
b. To make the reservation, the Renter is obliged to provide all necessary (personal) data of the Renter and his or her (fellow) travelers to the Inco Norway AS in a timely manner. This includes in any case name, address, cell phone number(s) and e-mail address(es)
c.An application for reservation of the vacation home shall only be made in writing or electronically.
d.If the Renter requests a reservation, the Renter will receive, within one working week, a confirmation of the reservation including the General Rental Conditions and the invoice.
e. The agreement between the Tenant and Inco Norway AS comes into effect as soon as the reservation is confirmed In Writing by the Inco Norway AS.
3. PAYMENT AND INVOICING
a.The rental fee (including fees and deposit) shall be paid by transferring the amount to the bank account number provided by Inco Norway AS.
b. Unless otherwise agreed in Writing, a deposit of 40% (forty percent) of the rental price shall be paid at the time of booking.
c. In principle, no later than 4 (four) weeks prior to arrival, the full rent is to be paid.
d. For bookings within four (four) weeks prior to arrival, the full rent must be paid at once (in full).
e. If - or after the first reminder - the payment obligation is not met, the reservation will expire without any obligation to refund a deposit already paid. The cancellation conditions of these General Rental Conditions also apply.
f.The lessee is obliged to immediately report inaccuracies and/or changes in the payment details provided or mentioned to Inco Norway AS.
g. If Inco Norway AS is forced to cancel the Lease due to force majeure or sale of the vacation home, it will inform the Renter in writing. Inco Norway AS thereby undertakes to immediately refund amounts already paid. The Renter expressly has no other right than to reclaim this amount.
4. DEPOSIT
a. The Renter shall pay a deposit.
The deposit of 250,00 EUR as stipulated in the Agreement must be paid with the deposit of the booking.
b. This deposit will be used if damage has been caused by the Renter, his co-tenants or visitors to the vacation home, its inventory and/or its surroundings, or if payment obligations have not been met.
c. The deposit will be refunded by Inco Norway AS to Tenant within two (2) weeks of return.
d. The final check for damages will be done after Tenant's departure. Inco Norway AS has the right to still recover such damages from the Renter if damages are found.
5. CANCELLATION
If the Renter wishes to cancel after the conclusion of the Agreement, the following points shall apply.
a. In the event of cancellation by the Renter no later than 90 (ninety) days or more before the date of arrival, the Renter will owe a compensation of 50% of the rent (excluding costs and deposit);
b. In case of cancellation by Tenant no later than 30 (thirty) days before arrival date, a compensation of 75% of the rent (excl. costs and deposit) is due by Tenant;
c. In case of cancellation by Tenant from 30 (thirty) days before arrival date, a compensation of d. The cancellation as stated in previous paragraphs shall be stated by the Renter In Writing to Inco Norway AS;
e.In case of subsequent relation, or premature termination of the stay in the vacation home, the full rental price including the cleaning fee remains due
f. If desired, the Tenant shall take care of his own cancellation insurance.
6. DISSOLUTION OF THE RENTAL AGREEMENT
a. If the tenant fails to pay the agreed rent (on time).
b. Force majeure, pandemics, war, strike, natural disaster, extraordinary weather conditions or fire.
c.All amounts paid by the tenant for unexpired nights will be returned to the tenant within 30 days of termination.
d. In case of complete cancellation by the landlord, another period may be agreed upon. If not, the full amount paid will be refunded to the tenant.
e.Due to circumstances of such a nature, performed by the Renter so that rental of the vacation home becomes impossible such as among others: theft of inventory, destruction of the vacation home and unauthorized entry of persons.
The amounts paid will not be returned in these circumstances.100% of the rental price (excluding costs and deposit) is due by Tenant;
7. ACCOMMODATION
a. In connection with the proper conduct of the stay, the Tenant is obliged to comply with guidelines of Inco Norway AS and the Tenant shall be held legally liable for any damages that would result from failure to comply with the guidelines or these General Rental Conditions.
b. The Renter undertakes to respect the vacation home including contents and its surroundings, including the noise level in the area.
c. The Renter is responsible for the vacation home including its contents/inventory during the stay. The Renter is expected to return the vacation home upon departure in the same condition as the vacation home was delivered at the start of the stay.
d. If damage has occurred, the Tenant must notify Inco Norway AS in writing preferably before departure or on the day of departure.
e. It is not allowed to use the vacation home for more persons than stated on the booking confirmation.
Furthermore, the Renter is obliged to the following with regard to the Rented Property:
a. No smoking in the Rented Property;
b. Forbidden to organize parties in the Rented Property;
c. To leave the rented property swept clean at the end of the rental period;
d. To have collected linen and bedding and to have collected them in a central location;
e. The Renter must return any household appliances present such as washing machine, oven or dishwasher clean and empty upon departure.
f. Crockery with accessories is to be returned clean to the cupboards. Moved furniture must be returned to its original place.
g. Empty trash cans and dispose of trash bags in the designated trash containers.
h. Pets are expressly not allowed in the Rented Premises.
8. LIABILITY DAMAGE
Inco Norway AS accepts no liability for:
a. Theft, loss or damage of any kind to the tenant while renting the vacation home.
b. The failure or rendering inoperative of technical equipment in the vacation home, temporary failure or malfunction of water, power supply and/or internet, road and/or construction work in the vicinity of the vacation home.
c. Damage or injury resulting from the use of the vacation home, including inventory, or accidents in and around the vacation home.
The Renter remains legally liable for damages
a. that he has caused, even if such damage is ascertained after the end of the stay.
b. his (not) actions as well as the actions of his co-tenants and visitors, as well as for the damage they cause.
c.Tenant must be insured against Civil Liability.
Complaints by the Tenant resulting from non-compliance between the house compared to the description on the site must be reported to Inco Norway AS within 24 hours of arrival.
9. CHECK-IN AND CHECK-OUT
a.There will be no personal key handover.
Please refer to the instructions the Renter has received regarding the key safe.
b. The Renter can check in on the day of arrival from 3:00 pm (in the afternoon).
c. The Renter must check out on the day of departure at 11:00 a.m. at the latest.
10. COMPLAINTS
a. If there are any defects in the vacation home, the Renter shall notify Inco Norway AS. The latter will make every effort to resolve the complaint as soon as possible and to the Renter's satisfaction.
b. The Tenant may notify Inco Norway AS of defects or shortages up to 36 hours after the commencement of the rental period.
c. If a complaint has not been reported to Inco Norway AS within the stipulated 36-hour period, it will be assumed that Tenant is satisfied and that the vacation rental complies with the Lease Agreement.
d. Complaints do not suspend the Tenant's payment obligation.
